Acceptable Use Policy

Effective 15 January 2026 · Applies to all workspace users

This Acceptable Use Policy ("AUP") describes the conduct required of every Subscriber and every workspace user of the ThaiHotelMinder advisory workspace and modules ("Services"). Compliance with this AUP is a condition of continued access to the Services. Serious or repeated breaches may result in suspension or termination of the workspace, in accordance with the Terms of Service.

1. Lawful use

You must use the Services only for lawful purposes, in compliance with all applicable Thai laws — including the Personal Data Protection Act B.E. 2562 (PDPA), the Hotel Act B.E. 2547, the Computer-Related Crime Act B.E. 2550 as amended by B.E. 2560, the Revenue Code, and the Consumer Protection Act B.E. 2522 — and in compliance with all applicable OTA and metasearch contracts to which your hotel property is a party.

2. Prohibited categories of use

The following uses are strictly prohibited:

  • Uploading, processing or storing any Personal Data for which you have not obtained the appropriate PDPA lawful basis.
  • Using the Services to defame, harass, discriminate against, or otherwise unlawfully target any individual, whether an employee of your hotel, a guest, a competitor, or a member of the general public.
  • Reverse-engineering the ThaiHotelMinder platform, its advisory algorithms, or its integration methods beyond what is expressly permitted by Thai law.
  • Attempting to gain unauthorised access to any part of the ThaiHotelMinder infrastructure, another Subscriber's workspace, or any Sub-Processor system.
  • Using the Services to distribute malware, viruses, worms, ransomware, or any other malicious code.
  • Using the Services to engage in market manipulation of published hotel rates in a manner that would violate the Consumer Protection Act B.E. 2522 or the Trade Competition Act B.E. 2560.
  • Sending unsolicited commercial communications ("spam") to guests or trade contacts from any workspace-hosted email address, in breach of the Computer-Related Crime Act.

3. HotelMinder API access

The read-only API key you grant to ThaiHotelMinder must respect the terms of your HotelMinder subscription. You must not use ThaiHotelMinder as a vehicle to circumvent any HotelMinder rate limit, licensing restriction, or data-export prohibition. If your HotelMinder subscription requires the retention of Personal Data within HotelMinder itself, you must not export that data through ThaiHotelMinder except as expressly permitted.

4. OTA contract compliance

The advisory recommendations produced by ThaiHotelMinder — particularly by the Agoda Parity Watchtower, the Channel Tuning module and the Groups & MICE Planner — are inputs to your commercial decision-making. You remain responsible for ensuring that any action taken on the basis of these recommendations complies with your contractual obligations to Agoda, Booking.com, Trip.com, Traveloka, Expedia, MakeMyTrip, Airbnb, or any other OTA or metasearch partner. You must not use ThaiHotelMinder to breach rate-parity clauses, exclusivity clauses, or minimum-inventory clauses you have contractually agreed with such partners.

5. Security-related conduct

  • Report any suspected security incident to security@thaihotelminder.org without delay.
  • Do not share your passwordless-login email address with unauthorised individuals. If your inbox is compromised, notify us within 24 hours so we can revoke active sessions.
  • Do not attempt to circumvent the audit-logging or rate-limiting mechanisms of the workspace.
  • Cooperate promptly with any security investigation initiated by ThaiHotelMinder.

6. Content standards

Any content you upload to the workspace, including notes attached to advisory recommendations, uploaded photographs used in mystery-guest reports, or comments in the bilingual review-response drafting queue, must not be defamatory, obscene, threatening, discriminatory, or in breach of Thai lèse-majesté or national-security laws. ThaiHotelMinder reserves the right to remove content that clearly breaches this standard and to notify Thai authorities where required by law.

7. Guest reviews

The Review Response Thai/EN module drafts responses that are subsequently published under your hotel's identity on external review platforms. You are the author of record for every response published. You must review each draft before publication and ensure it complies with each platform's own content policy (Google, TripAdvisor, Agoda, Booking.com, Trip.com, Traveloka) and with Thai defamation law (Criminal Code s.326–s.328).

8. Fair-use limits

Automated advisory-pack generation is subject to fair-use limits documented in each module's product page (typically bounded by daily API pull frequency and by the volume of records exchanged). Sustained use above the fair-use limit may result in throttling. Persistent circumvention of the limits may result in suspension.

9. Enforcement

Where we suspect a breach of this AUP, we may (a) request that you remedy the breach within a reasonable timeframe; (b) suspend the affected module while investigating; (c) terminate the workspace for material or repeated breaches. We escalate to Thai law-enforcement authorities where required by law.

10. Reporting abuse

To report abuse of the ThaiHotelMinder workspace by another user, or to report a security vulnerability, write to security@thaihotelminder.org with as much detail as you can provide. Responsible disclosure of security vulnerabilities is rewarded under our bug-bounty programme (up to THB 90,000 per confirmed critical vulnerability).

11. Changes to this AUP

We may update this AUP from time to time. Material changes are announced 30 days in advance in the workspace. Non-material changes take effect on publication.

12. AI-generated content

Some ThaiHotelMinder modules — notably the Review Response Thai/EN and the Channel Tuning advisory drafts — rely on machine-generated text as a starting point. You must not (a) publish AI-generated content without human editorial review; (b) hold ThaiHotelMinder out as the author of published content produced through the Services; (c) use the Services to generate content that impersonates a real person, or to fabricate reviews or testimonials.

13. Prohibited industries

The Services must not be used in support of any of the following business activities, even where they are legal in Thailand: (a) gambling establishments regulated under Thai gambling laws; (b) any activity subject to money-laundering scrutiny under the Anti-Money Laundering Act B.E. 2542; (c) any commercial sexual services (Prostitution Suppression and Protection Act B.E. 2539); (d) trafficking of any nature; (e) any activity prohibited by Thai lèse-majesté (Criminal Code s.112) or national-security laws.

14. Reputation and defamation

Content published through the Services (e.g. bilingual review responses) is subject to Thai defamation law (Criminal Code s.326–s.328) and the Computer-Related Crime Act B.E. 2550 as amended B.E. 2560. You are the author of record for every publication and must exercise reasonable editorial judgement before posting.

15. Use of the ThaiHotelMinder trademark

The "ThaiHotelMinder" trademark, the ◆ TH mark, and the associated brand assets remain the property of ThaiHotelMinder Co., Ltd. You may reference our name in factual disclosures ("Our hotel uses ThaiHotelMinder advisory") but may not use our trademark to imply endorsement of your property, or in any manner that would confuse the reader as to the independence of our commentary.

16. Compliance with OTA-specific policies

Every OTA imposes content and behavioural policies on partners publishing through its channels. This includes but is not limited to Agoda Partner Terms, Booking.com Extranet Content Guidelines, Trip.com Group Partner Policies, Traveloka Extranet Rules, MakeMyTrip Vendor Code, and Airbnb Community Standards. You remain solely responsible for compliance with each OTA's own policies when acting on ThaiHotelMinder advisory recommendations.
